Last updated: October 22, 2026
Effective: October 22, 2026
These Terms of Service (“Terms”) govern your use of the infinito-host.com website, the client area, and all hosting, domain, email, AI page builder and related services (the “Services”) offered by Infinito Global Investment S.A., a corporation (sociedad anónima) organized under the laws of the Republic of Nicaragua, located at Bello Horizonte BII-40, Managua, Nicaragua, doing business as Infinito (“Infinito,” “we,” “us”).
By creating an account, placing an order, or using the Services, you agree to these Terms and to the following policies, which are part of them:
- Privacy Policy
- Cookie Policy
- Acceptable Use Policy
- Refund and Cancellation Policy
- Availability and Support Policy
- Domain Registration Terms
- AI Page Builder Terms
- Copyright Policy
If you do not agree, do not use the Services.
1. Eligibility
1.1. You must be at least 18 years old and legally able to enter into contracts in your country.
1.2. If you contract on behalf of a business, you represent that you have authority to bind it; “you” then also refers to that business.
1.3. The Services may not be purchased by persons, or from countries, subject to international sanctions that prevent us from providing the service or processing the payment.
2. Account
2.1. You must provide true, complete, and current information (name, company, address, email, phone) and keep it up to date.
2.2. You are responsible for keeping your passwords confidential and for all activity in your account. We recommend enabling two-step verification when available.
2.3. We may require identity or payment-method verification before activating a service or when fraud is suspected. If verification is not completed, we may cancel the order and refund any amount paid.
2.4. We will act on account requests (ownership changes, transfer codes, access) only from the account holder or a verified authorized contact.
3. Services
3.1. The features, resource limits (disk space, bandwidth, email accounts, databases, CPU, memory, processes, emails per hour, etc.) and prices of each plan are those published on the website or in the client area at the time of purchase.
3.2. No plan is “unlimited” in an absolute sense. Where a plan uses terms such as “unlimited” or similar, reasonable use typical of a small or medium-sized business website on a shared server applies, as described in the Acceptable Use Policy.
3.3. Hosting Services are provided on infrastructure from third-party data center and software providers (for example, control panels, application installers, billing systems), located mainly in the United States. We may change providers or infrastructure without materially reducing the features you purchased.
3.4. Design and onboarding services. Website creation and onboarding packages (for example, a basic 5-page website), which may also be marketed under the Infinito.Agency brand, are provided by Infinito Global Investment S.A., directly or with partners. Scope, deliverables and timelines are defined in the package description or the accepted proposal. Where a package includes the first year of hosting and a domain, those are governed by these Terms.
3.5. Third-party software. Applications such as WordPress, themes, plugins or scripts installed by you or through automatic installers are third-party products. Their licensing, security and updates are your responsibility unless you expressly purchase a maintenance service.
3.6. Beta features. Some features may be labeled “beta” or “preview.” They are provided as is, may change or be withdrawn, and are not covered by any availability target.
4. Orders, Prices and Taxes
4.1. All prices are in U.S. dollars (USD) unless another currency is shown at checkout.
4.2. Displayed prices indicate whether taxes are included. Where applicable, we will add Value Added Tax (IVA) or other taxes required under Nicaraguan law and, where relevant, the law of the customer’s country. The total price is shown before you confirm payment.
4.3. Promotional or first-term prices apply only to the stated term. Renewals are charged at the then-current regular rate, which is shown before purchase.
4.4. We may change renewal prices with at least 30 days’ notice by email. The change applies from the next renewal; you may cancel before it takes effect.
4.5. An order is accepted when the service is activated. We may refuse or cancel an order, refunding any amount paid, for an obvious pricing error, suspected fraud, failed verification, or breach of these policies.
5. Payments and Automatic Renewal
5.1. You may choose PayPal or Stripe from the payment methods available at checkout. PayPal may allow payment from your balance or by card; Stripe processes card payments. Full card details are handled by the processor you choose; we neither receive nor store them.
5.2. Automatic renewal. If you choose automatic renewal at checkout or authorize a recurring payment agreement with your selected processor, the service will renew at the end of each billing cycle (monthly, annual or other selected term) for the same period, and the then-current renewal price plus taxes will be charged. If no automatic payment is authorized, we will issue the renewal invoice before the due date for you to pay.
5.3. For annual or longer services, we will email you a reminder 15 to 45 days before renewal, stating the price and how to cancel.
5.4. How to cancel renewal: you may turn it off at any time in the client area (“Request Cancellation,” or by disabling a domain’s auto-renew), by cancelling the automatic payment agreement with PayPal or Stripe as applicable, or by emailing soporte@infinito-host.com. Cancellation takes effect at the end of the paid term unless the Refund Policy provides otherwise.
5.5. Invoices are issued in the client area before the due date. If a charge is declined, we will notify you so you can update your payment method.
5.6. Non-payment. If an invoice is not paid:
- 7 days after the due date the service may be suspended;
- 30 days after the due date the service may be terminated and its content permanently deleted.
We will send you email notices before suspension or termination. Domains follow their own expiration dates under the Domain Terms.
5.7. Payment disputes. If you open a dispute or chargeback in PayPal or with your bank without contacting us first, we may suspend the related services while it is resolved. If the dispute is resolved in our favor, you must pay the amount owed to reactivate them.
6. Your Content and Data
6.1. You retain all rights to the content, files, data, code and materials you host or upload (“Your Content”).
6.2. You grant us a limited, non-exclusive, worldwide license to store, copy, transmit and display Your Content solely as needed to provide, back up and protect the Services.
6.3. You are solely responsible for Your Content and for having the necessary rights and permissions. We do not pre-screen content, but we may act on complaints or signs of violation under the Acceptable Use Policy and the Copyright Policy.
6.4. Your site visitors’ data. If your site collects personal data from third parties (forms, stores, subscribers), you are the controller of that processing and we act as a processor: we will process that data only to provide the Services, according to your instructions, with reasonable security measures, without selling it, and we will notify you without undue delay if we detect a security incident affecting it. You must publish your own privacy notice, obtain any consents required by law, and comply with the rules that apply to your business.
6.5. Servers in the United States and consent to data transfer. The Services are provided from servers and providers located mainly in the United States. By accepting these Terms and purchasing any Service, you give your express and informed consent to your personal data and Your Content being transferred to, stored and processed in the United States and, depending on the service, in other countries where our providers operate, in accordance with the Privacy Policy. This transfer is necessary to provide the Services, so they cannot be purchased without it. You may withdraw this consent as described in the Privacy Policy; withdrawal will result in the cancellation of the Services that depend on the transfer.
7. Backups
7.1. We may perform periodic infrastructure backups for disaster recovery. Those backups do not replace your own backups, and we do not guarantee their frequency, integrity or availability.
7.2. We recommend keeping current copies of Your Content off our servers. The control panel backup tools are available to you for that purpose.
7.3. On-demand restorations may carry a fee according to the published rate.
8. Security
8.1. We apply reasonable technical and organizational measures to protect the infrastructure. No system is completely secure.
8.2. You must keep the software you install up to date, use strong passwords and not share access. Compromised accounts (malware, spam, phishing) may be suspended to protect other customers until they are cleaned.
9. Acceptable Use and Resources
You must comply with the Acceptable Use Policy. If your account uses resources in a way that affects the server or other customers, we may limit processes, temporarily suspend the affected site, or ask you to move to a higher plan, notifying you when possible.
10. Suspension and Termination
10.1. By you: you may cancel any service at any time under Section 5.4.
10.2. By us: we may suspend or terminate a service, with or without prior notice depending on severity, if: (a) you breach these Terms or their policies; (b) there is non-payment; (c) there is a risk to security, the network, other customers or third parties; (d) the law or a competent authority requires it; or (e) there are reasonable signs of fraud. Where reasonable, we will notify you and give you an opportunity to cure.
10.3. If we terminate a service for reasons not attributable to you, we will refund the unused prorated portion of the paid term.
10.4. After termination, Your Content may be permanently deleted. If termination is not due to serious abuse or a legal order, we will give you 14 days to download your content where technically possible. Domains registered in your name remain yours and may be transferred under the Domain Terms.
11. Infinito Intellectual Property
The website, the Infinito and Infinito.Agency brands, logos, templates, designs, software and documentation belong to Infinito Global Investment S.A., its affiliates or its licensors. You receive no rights in them other than using the Services under these Terms. If you send us suggestions, we may use them without any obligation to you.
12. Third-Party Services
The Services may integrate or link to third-party services (PayPal, Stripe, domain registrars and registries, AI providers, open-source software, SSL certificates). Their use is subject to those third parties’ terms, and we are not responsible for their acts or omissions, except to the extent the law does not allow us to exclude it.
13. Warranties
13.1. We will provide the Services with professional diligence and as offered. However, we do not warrant that they will be uninterrupted or error-free, or that you will achieve specific business results (sales, search rankings, email deliverability). Our availability commitments are those described in the Availability and Support Policy.
13.2. If you are a consumer, you retain the warranties granted to you by applicable consumer protection law.
14. Limitation of Liability
14.1. Business customers. If you contract for the purposes of your business or professional activity, and to the maximum extent permitted by law: (a) we will not be liable for indirect damages, lost profits, or loss of data, revenue or business opportunities; and (b) our total liability for any claim related to the Services will not exceed the amount you paid us for the affected service during the 12 months before the event giving rise to the claim. This limitation does not apply in cases of fraud (dolo) or gross negligence.
14.2. Consumers. If you are a consumer, nothing in these Terms excludes or limits our liability where the law prohibits it, including Nicaragua’s Law No. 842 on the Protection of the Rights of Consumers and Users, nor any non-waivable rights granted to you by the laws of your country.
15. Indemnification
You will be responsible to us for third-party claims, fines and reasonable expenses (including attorneys’ fees) arising from Your Content, your use of the Services in breach of these Terms or the law, or your violation of third-party rights, except to the extent caused by our own fault.
16. Governing Law
These Terms are governed by the laws of the Republic of Nicaragua. If you are a consumer residing in another country, this does not deprive you of the protection of the mandatory rules of your country of residence.
17. Dispute Resolution
17.1. Contact us first. Email legal@infinito-host.com describing the problem and the resolution you seek. We will respond within 10 business days and try to resolve it in good faith.
17.2. Consumers in Nicaragua. You may file a complaint with the General Directorate for the Protection of the Rights of Consumers and Users (DIPRODEC) of the Ministry of Development, Industry and Trade (MIFIC), or go to the competent courts.
17.3. Voluntary mediation and arbitration. Once a dispute has arisen, the parties may agree to submit it to mediation or arbitration under Nicaragua’s Law No. 540 on Mediation and Arbitration. Arbitration will never be mandatory for consumers. Business customers and we may agree to it in writing.
17.4. Courts. Absent agreement, disputes will be submitted to the competent courts of Managua, Nicaragua, without prejudice to a consumer’s right to sue in the courts of their domicile where the law allows.
18. Changes to These Terms
We may update these Terms. We will publish the new version with its date. If a change is material, we will notify you by email or in the client area at least 30 days in advance. Continued use after the effective date means acceptance; if you do not agree, you may cancel before that date and, if the change is to your detriment, request a prorated refund of the unused paid term.
19. General Provisions
19.1. Notices. We will send notices to your account email. Legal notices to us must be sent to legal@infinito-host.com.
19.2. Force majeure. We are not liable for failures caused by events beyond our reasonable control (natural disasters, power or telecommunications provider failures, large-scale attacks, government actions).
19.3. Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or successor with prior notice to you.
19.4. Severability. If any provision is invalid, the rest remains in effect.
19.5. Waiver. Failure to enforce a right is not a waiver of it.
19.6. Entire agreement. These Terms and the incorporated policies are the entire agreement regarding the Services.
19.7. Language. These Terms are published in Spanish and English. In the event of any conflict or discrepancy, the Spanish version prevails.
